General Terms and Conditions of Sale – KALINATUR

Article 1 – Definitions

These General Terms and Conditions of Sale (hereinafter " GTC ") are offered by KALINATUR , micro-enterprise, Promenade des Anglais, 06000 Nice, France.
Contact: service-kalinatur@gmail.com – Website: https://www.kalinatur.com (hereinafter the “ Site ”).

“ Products ”: products sold on the Site (category: Baby & Mother / cocooning).
“ Customer ”: any buyer, whether private individual or professional.
“ Consumer ”: natural person acting for non-professional purposes (preliminary art. Consumer Code).

The Customer acknowledges having read and fully accepted the Terms and Conditions before placing any order.

Article 2 – Application of the General Terms and Conditions and Purpose of the Site

KALINATUR reserves the right to modify the Terms and Conditions at any time; the applicable Terms and Conditions are those in effect on the day of the order .
The Site offers online sales of products for family, maternity and cocooning .
Acceptance of the terms and conditions is done by ticking the corresponding box when placing the order and constitutes a signature.

Article 4 – Ordering – Purchasing Process

The Customer adds the Products to their Basket , then successively validates the steps Information → Delivery → Payment → Confirmation .
A summary allows for verification and correction of any errors before payment.
The sale is formed upon confirmation of the order and payment of the price.
The images are not contractual (differences may occur depending on screens/brightness/shooting).

Article 5 – Price and payment terms

Prices are shown in euros including VAT , excluding any shipping costs displayed before payment.
Accepted payment methods: Credit card (Visa/Mastercard/Amex), PayPal, Apple Pay, Bancontact .
Payments are processed via secure providers; the Site does not have access to bank details.
Archiving of purchase orders and invoices on reliable media.
In the case of a bank transfer , delivery times begin from the actual receipt of funds.

Article 6 – Deliveries

Fees : €4.90 – waived for purchases of €50 or more .
Indicative delivery times : processing 1 to 2 working days , then delivery 5 to 7 working days (excluding cases of force majeure/disruptions).
Tracking provided by La Poste Colissimo / ColiColi / Colis Privé .
Outside the EU / French Overseas Departments and Territories: the Client is the importer and bears any applicable duties and taxes.
Maximum legal period for a Consumer: 30 days after conclusion of the contract.
Package "delivered" but not received: the Customer contacts the Seller; an investigation and/or a reshipment may be offered.
Package returned to sender (incomplete address/refusal/INL): reshipment possible after payment of new shipping costs or refund deducted from initial shipping costs if applicable.

Article 7 – Right of withdrawal (Consumer)

Legal deadline: 14 days from receipt.
Return shipping at the customer's expense, product must be new, unused, complete and undamaged .
Refund via the same payment method , upon receipt of the Products or proof of shipment (the Seller may defer until receipt).
Depreciation attributable to excessive handling: Customer responsibility.

KALINATUR commercial policy : regardless of the statutory 14-day right, the Customer benefits from a possible return of up to 30 days (see page "Returns & Refunds").

Article 8 – Legal Guarantees

Compliance (Consumer Code L.217-3 et seq.): repair/replacement, or refund if impossible.
Hidden defects (Civil Code art. 1641 et seq.): action within 2 years from the discovery of the defect (rescission or price reduction – art. 1644).
These guarantees apply independently of any commercial warranty.

Article 9 – Liability

KALINATUR cannot be held responsible in cases of force majeure (art. 1218 C. civ.) nor for indirect damages (loss of profit, data, etc.).
The choice of Product is the sole responsibility of the Customer ; incompatibility of use: no compensation, except for hidden defects/non-conformity/right of withdrawal.

Article 10 – Force majeure

Suspension of obligations for the duration of the event.
After 90 days of persistence, each party may cancel the order by registered letter with acknowledgment of receipt without compensation.

Article 11 – Intellectual Property

All elements of the Site (texts, visuals, logos, videos, trademarks) are protected.
Any reproduction/distribution, even partial, is prohibited without written permission from KALINATUR.
All hyperlinks require prior agreement; removal is possible upon simple request.

Article 12 – Personal Data

KALINATUR processes data in order to: manage orders and customer relations , improve the Site , prevent fraud , and conduct marketing activities with consent .
Providers involved (payment, logistics, Shopify Inc. hosting).
Retention periods adapted to the purposes (max. 5 years for customer/order data excluding specific legal obligations).
GDPR rights (access, rectification, erasure, restriction, objection, portability, post-mortem directives) can be exercised by contacting service-kalinatur@gmail.com .

Article 13 – User Comments and Content

The Client grants KALINATUR a non-exclusive license to edit, publish and use the submitted reviews/comments, without obligation of confidentiality or compensation.
The following are prohibited: illegal, defamatory, counterfeit, malicious, viral content, identity theft.
The Client is solely responsible for their publications.

Article 14 – Independence of clauses

The invalidity of one clause does not affect the validity of the others.

Article 15 – Applicable Law – Amicable Settlement and Mediation – Jurisdiction

The terms and conditions are governed by French law .
In case of dispute, the Client should first contact service-kalinatur@gmail.com for an amicable resolution.
The Consumer Client may use the European online dispute resolution ( ODR ) platform:
https://ec.europa.eu/consumers/odr/
In the absence of an amicable agreement or mediation, jurisdiction lies with the territorially competent French courts .

Article 16 – SMS Policy (if applicable)

By consenting to KALINATUR 's SMS marketing during checkout or via our subscription tools, you agree to receive recurring SMS messages (order notifications and offers). Consent is not a condition of purchase.
To unsubscribe: reply STOP to the SMS you received or use the unsubscribe link. Operator charges (SMS/data) may apply.

Article 17 – Commercial warranty for parts (if applicable)

Limited commercial warranty of 30 days following purchase, for normal use and excluding external causes.
The commitment consists of replacing the defective part .
This commercial guarantee applies without prejudice to the legal guarantees (art. 8).
